01 · Agreement to these terms

Using the site means accepting these website terms.

By using hderent.com, creating an account, submitting a request, or making an online payment, you agree to these Website & Payment Terms and acknowledge the Privacy Policy. Every equipment rental is also governed by the current Rental Service Agreement, the reservation details, and any written quote or product-specific requirements. If these website terms conflict with a signed rental agreement about rental equipment, the signed rental agreement controls.

02 · Accounts & eligibility

Accurate information and authorized use.

• You must be legally able to enter a binding agreement and satisfy the identification, operator, and towing qualifications applicable to the rental.
• Provide current, accurate contact, identity, insurance, and payment information. Do not use another person's account or secure sign-in code.
• You are responsible for activity performed through your account and for promptly telling HDER about suspected unauthorized access.
• HDER may suspend an account or decline a transaction for safety concerns, fraud, unpaid balances, prohibited use, or a material breach of an HDER agreement.

03 · Reservations, holds & availability

Availability is checked again at checkout.

Equipment shown online may become unavailable because another customer completes checkout, a physical unit is returned damaged, maintenance is required, or an inventory record must be corrected. The site may place a short temporary hold while you complete payment. A reservation is confirmed only after the required account steps, agreement acceptance, and payment are successfully completed and HDER issues a confirmation.

HDER may substitute reasonably comparable equipment with the customer's approval or cancel and refund the affected rental payment if the reserved equipment cannot be supplied. HDER does not guarantee that a request, abandoned cart, expired hold, quote, or unconfirmed reservation will remain available.

04 · Pricing, taxes & corrections

The price shown for the selected duration is the starting rental charge.

Rental rates, security deposits, optional services, delivery charges, taxes, and other disclosed amounts are shown before payment or confirmed in a written quote. Sundays may be skipped as nonbillable time where the booking calendar states that rule. Rates may change for future reservations, but HDER will not change the confirmed base rental charge without notice and the customer's agreement, except to correct an obvious error.

If the site contains a material pricing, description, availability, or technical error, HDER may correct it and decline or cancel the affected transaction. If HDER cancels after collecting the base rental payment, HDER will refund that payment to the original payment method.

05 · Card payments & security deposits

Stripe processes the card; HDER manages the rental.

• By submitting payment, you authorize Stripe and HDER to charge the amount shown at checkout and to store a reusable payment-method reference for this rental and future transactions you authorize.
• HDER does not receive your complete card number or card security code.
• Unless waived through approved insurance, the listed security deposit is normally authorized as a temporary card hold when HDER checks the equipment out. It is not the same as the base rental charge.
• After return, HDER may release the hold or capture an amount permitted by the Rental Service Agreement. A charge above the authorization requires a separate payment action or other authorization allowed by the agreement and law.
• Card issuers control when released authorizations and refunds become available. HDER cannot accelerate a bank's posting schedule.
• You remain responsible for authorized additional rental time, fuel, excess cleaning, damage, missing items, towing, recovery, impound, storage, fines, and other amounts allowed by the signed Rental Service Agreement.

06 · Cancellations, changes & refunds

Contact the office as soon as plans change.

A cancellation within 24 hours of the scheduled rental may incur a $50 cancellation fee. Extension requests and schedule changes require HDER approval and may change the price. Refunds, credits, and additional charges are determined under the reservation details, Customer Rental Policies, and Rental Service Agreement. Any refund due will be returned to the original payment method unless law requires otherwise.

07 · Electronic signatures & communications

Email and electronic acceptance count.

You consent to receive account links, confirmations, agreements, receipts, policy updates, service quotes, and other transaction communications electronically. Typing your legal name and selecting the agreement acceptance control creates an electronic signature for the displayed agreement version.

Rental text updates are optional and are not a condition of purchase. If you opt in, message frequency varies and carrier message or data rates may apply. Reply STOP to opt out or HELP for assistance. Operational email may still be sent for an active account, reservation, payment, service request, or legal notice.

08 · Acceptable website use & intellectual property

Use the site for legitimate HDER business.

Do not interfere with the site, bypass security or availability controls, submit false information, impersonate another person, scrape the site at unreasonable volume, introduce malicious code, reverse engineer protected systems, or use the site for unlawful activity. HDER may block abusive traffic and preserve related records.

The HDER name, site design, writing, graphics, product photographs owned by HDER, and software are protected by applicable intellectual-property law. You may use the site for personal or internal business rental activity, not to republish or commercially exploit its content without permission.

09 · Disclaimers, limits & governing law

The website helps arrange service; it cannot eliminate every interruption.

The site is provided on an “as available” basis. HDER works to keep rates, inventory, and account records accurate, but does not warrant uninterrupted access or that every display will always be error-free. To the fullest extent permitted by law, HDER is not liable for indirect, incidental, special, exemplary, or consequential loss caused solely by use of or inability to use the website. Nothing here limits liability that cannot legally be limited or changes the separate risk and responsibility terms in the signed Rental Service Agreement.

These terms are governed by Oregon law, without regard to conflict-of-law principles. If any provision is unenforceable, the remaining provisions continue in effect. HDER's failure to enforce a provision once is not a waiver. We may update these terms by posting a revised effective date; a material change affecting an existing paid reservation will not retroactively change that reservation without notice.
